By providing your mobile number and opting in (e.g., via form, keyword, or explicit consent), you agree to receive these messages from TN Bounce House, LLC. Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

To opt out, reply STOP (or UNSUBSCRIBE, CANCEL, END, QUIT) to any message. Reply HELP for info or assistance. You may also contact us to manage preferences.

Important Mobile Data Note: We do not share mobile information (including phone numbers or SMS opt-in/consent data) with third parties or affiliates for marketing/promotional purposes. This excludes sharing with SMS delivery providers (e.g., Twilio) solely to facilitate messaging, who are bound by confidentiality and compliance rules.

4. Rental-Specific Terms

Our Website facilitates bounce house, inflatable (e.g., water slides, combos), and party equipment rentals (e.g., tents, tables) in Middle Tennessee. All rentals are governed by:

• A separate written or electronic Rental Agreement.
• A Liability Waiver/Release that you must sign/accept.
• On-site safety rules and instructions.

Key rental terms include (but are not limited to):

• Deposits/Payments: A deposit is required to reserve; full payment due before delivery/setup.
• Cancellation/Refunds: Policies vary; cancellations may forfeit deposits.
• Setup/Delivery: We handle delivery/setup where agreed; you provide suitable site (flat, clear area, no overhead hazards).
• Supervision: A responsible adult (18+) must supervise the inflatable at all times during use.
• Capacity/Safety Rules: Follow posted rules (e.g., no flips, shoes off, age/weight limits, no sharp objects).
• Weather/Force Majeure: Rentals may be canceled/rescheduled for unsafe weather (e.g., high wind, rain); no liability for weather-related issues.
• Damage/Cleaning: You are responsible for damage beyond normal wear; cleaning fees may apply.

5. Liability, Assumption of Risk, and Indemnification

Inflatable rentals involve inherent risks, including but not limited to slips, falls, collisions, equipment failure, weather, and misuse, which may cause serious injury, death, or property damage.

Assumption of Risk: By renting/using our equipment, you acknowledge these risks and voluntarily assume them.

Release of Liability: To the fullest extent permitted by law, you release TN Bounce House, LLC, its owners, employees, and agents from all claims, liabilities, damages, or injuries arising from use of our equipment, except for gross negligence or willful misconduct.

Indemnification: You agree to indemnify, defend, and hold us harmless from any claims, losses, damages, liabilities, costs (including reasonable attorneys' fees) arising from your use/misuse of the equipment, violation of these Terms, or negligence.

We maintain required Tennessee amusement device compliance (annual inspections, permits) and liability insurance (minimum $1,000,000 per occurrence). Proof available upon request.

6. Intellectual Property

All Content on the Website is our property or licensed to us and protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, or create derivative works without written permission.

7. Third-Party Links

The Website may link to third-party sites. We provide these for convenience only and have no control over their content/privacy. Access at your own risk; we disclaim liability.

8. Disclaimer of Warranties

The Website and services are provided "as is" without warranties of any kind, express or implied. We do not warrant uninterrupted access, error-free operation, or fitness for a particular purpose.

9. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the Website or services, even if advised of the possibility.

10. Governing Law and Dispute Resolution

These Terms are governed by Tennessee law, without regard to conflict of laws. Any disputes shall be resolved exclusively in courts located in Maury County, Tennessee (or applicable county). You agree to submit to personal jurisdiction there. Claims must be brought within one (1) year.

11. General Provisions

• Severability: If any provision is invalid, the remainder remains in effect.
• No Waiver: Failure to enforce a provision does not waive it.
• Survival: Provisions on liability, indemnification, IP, and governing law survive termination.
• Entire Agreement: These Legal Terms supersede prior agreements.
